GNI gives independent and objective advice and provides its clients with confidence in the commercial and contractual aspects of project delivery from commencement through all phases of the construction process to rectification of defects, resolution of disputed matters and to final account agreement.

Services are delivered to all parties involved in the industry and across all sectors of construction and engineering including employers, consultants, contractors, subcontractors and suppliers.

SERVICES PROVIDED:

Project, Contract and Commercial Advisory including:

  • Interpretation of the agreed contract terms and the implementation of measures to manage risk and ensure compliance with obligations.
  • Contractual positioning with the purpose of protection and/or to ensure full entitlement.
  • Contract administration including the issue of correspondence and contractual notices.
  • Commercial support with the purpose of securing entitlement to interim payment and final account.

Contractual entitlement and claims management including:

  • Advice on the validity of claims for contractual entitlement, whether for extensions of time, loss and expense or general damages.
  • Claim advocacy and the management of claim preparation, submission and resolution.
  • Assessment, negotiation and resolution of entitlement whether during a project’s course or on completion, by means either of negotiation or alternative dispute resolution.

Dispute avoidance and dispute resolution, including:

  • Analysis of issues, proposal and management of strategy with the purpose of achieving satisfactory outcome through negotiation whilst mitigating cost.
  • Advocacy, presentation and submission of disputes to Adjudication, from initial Notice of Adjudication through adjudicator appointment to Referral, Response, Reply and Decision.
  • Acting as adjudicator of construction disputes under the Housing Grants, Construction and Regeneration Act 1996.
  • Acting as Mediator to assist parties in resolving their dispute, or alternatively acting for parties as their party representative.

Expert witness:

  • Providing expert opinion on matters of dispute.

Examples of recent appointments have included:

  • A 26-month appointment to the account for an office refurbishment and fit-out to a substantial and iconic building on the Strand, providing advice and support in securing entitlement to fair valuation and additional time with money through negotiation and multiple successful adjudications. Project value £40m.
  • A 24-month long appointment to a mixed-use development in Euston, providing advice and support in securing entitlement to proper upstream valuation and additional time with money, and in successfully defending multiple supply chain adjudications. Project value £75m.
  • Super Prime homeowner appointment to provide contractual advice in connection with the contractor’s performance on a Super Prime residential refurbishment in St. John’s Wood.
  • Expert quantum advice in connection with the refurbishment of a substantial homeowner residence in Cambridge following abandonment of the works by the contractor, resulting in considerable reconstruction and remedial works.  
  • Provision of training and advice in the bespoke form of contract agreed, with the purpose of managing risk, ensuring compliance with obligations and providing protection against breach, in connection with an office fit out of a number of floors at Battersea Power Station. Project value £130m.  
  • Commercial support resulting in entitlement to final account on projects for a developer in Frankfurt and for an internationally recognised investment firms’ office in Geneva.
  • Domestic homeowner appointment to act as party representative in the successful defence and counter claim against a contractor that launched adjudication proceedings for substantial additional sums.
  • Appointment to act as adjudicator on 8No occasions during 2023, in the matter of formal disputes between parties. 
  • Providing executive advice to provide protection and positioning of the contractor when undertaking in excess of 1million square feet of headquarter office fit out for an internationally recognised investment banking firm. Project value £230m.
